Abstract

Prompted by the ECtHR’s invocation of Article 3 ECHR in its communication to the parties in Duarte Agostinho and Others v Portugal and Others, and with particular focus on children and young people, this paper considers the principled basis for finding that State (in)action in relation to climate change violates the right not to be subjected to torture or inhuman or degrading treatment or punishment under Article 3 ECHR.
