Germany rearmed: The impact of the Ukraine War on German defence procurement law and policy

Abstract

The Ukraine War had a detectable impact on defence procurement in Germany: large additional funds were made available to jump start a better equipped Bundeswehr, a substantially rising defence budget, and the ‘Acceleration Act’ which aims to remove actual or perceived obstacles to the defence procurement process. However, the acceleration of public procurement is to be achieved predominantly with direct awards and limitations of legal protection. It is questionable whether all these provisions comply with EU law and the Acceleration Act could lead to (even) less transparency and competition in defence procurement.
